1. Scope
These General Terms & Conditions apply to purchases and commissions made through this website and between Janine Grosche / PATH and the customer.
By placing an order through this website, the customer agrees to these Terms & Conditions.

3. Nature of the Work
PATH is an artistic and material practice by Janine Grosche focused on handcrafted wearable objects, translucent latex skins, and experimental material processes.
All works are individually produced by hand using artisanal and self-developed techniques. Due to the handmade nature of the work, minor variations in translucency, texture, colour, surface, pattern, and form are inherent to the production process and do not constitute defects where they are characteristic of the work and do not impair its agreed use.
Each piece is unique and may vary slightly from images or samples shown on the website.
Statutory warranty rights remain unaffected.
4. Materials & Care
PATH latex works contain natural rubber latex. Natural latex may cause allergic reactions in sensitive individuals. Customers with a known or suspected latex allergy should not wear or handle latex pieces.
The materials used in PATH works require careful handling and storage. Pieces should be protected from excessive heat, prolonged sunlight, oils, unsuitable metals, sharp objects, excessive friction, and unsuitable storage conditions.

Damage resulting from improper handling, use contrary to the provided care instructions, unsuitable storage, or normal wear and ageing does not constitute a product defect where PATH is not legally responsible for such damage.
Statutory liability and warranty rights remain unaffected.
5. Made-to-Order & Custom Works
All PATH works are individually produced after an order has been placed. No finished garments or prefabricated latex skins are held in stock.
For latex works, the individual latex skin is handcrafted after the order is received before the final piece is constructed.
Pieces may be offered in standard sizes XS–L or as Made to Measure.
Made-to-Measure and other custom works are produced according to the customer's individual measurements, selections, specifications, or personal requirements. Customers are responsible for providing accurate measurements and specifications where required.
For goods made according to individual customer specifications or clearly tailored to the customer's personal requirements, the statutory right of withdrawal does not apply in accordance with § 312g Abs. 2 Nr. 1 BGB.
For made-to-order works that do not meet the legal requirements for this exception, statutory withdrawal rights remain unaffected.
Production begins after payment has been received.
6. Prices & Payment
All prices displayed on the website are final prices.
Due to the application of the small-business regulation pursuant to § 19 UStG, VAT is not charged or separately shown.
Shipping costs are additional unless expressly stated otherwise and are displayed during checkout before the order is completed.
Payment is due upon placing the order using the payment methods offered at checkout. Payments are processed through Stripe.
7. Production, Shipping & Delivery
All works are produced after an order has been placed. Production may take up to 20 working days before dispatch, unless a different production time is stated on the respective product page or agreed individually.
Shipping and delivery time is additional to the production period.
Orders are shipped using the shipping methods indicated during checkout. Delivery times may vary depending on the destination and shipping provider.
For deliveries outside the European Union, customs duties, import taxes, or other charges may be imposed by the destination country. Where applicable, these charges are the responsibility of the customer and are not included in the product or shipping price.
PATH is not responsible for delays caused by circumstances outside its reasonable control, including customs processing or carrier delays. Mandatory statutory rights concerning delivery and transfer of risk remain unaffected.
8. Right of Withdrawal
Consumers have the statutory right of withdrawal where provided by applicable law.
The statutory right of withdrawal does not apply to goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to the consumer's personal needs, in accordance with § 312g Abs. 2 Nr. 1 BGB.
This applies in particular to Made-to-Measure, personalised, and other custom works produced according to the customer's individual measurements or specifications, provided the statutory requirements for the exception are met.
For standard made-to-order works for which the statutory exception does not apply, the consumer's statutory right of withdrawal remains unaffected.

9. Warranty & Liability
Statutory warranty rights apply.
Minor variations resulting from the handmade production process, including variations in surface, translucency, texture, pattern, colour, and form, do not constitute defects where they are characteristic of the individual work and do not impair its agreed use.
Natural material ageing and changes resulting from normal use, wear, improper handling, or failure to follow the provided care instructions do not constitute defects where PATH is not legally responsible for them.
PATH is liable without limitation in cases of intent and gross negligence and for damages arising from injury to life, body, or health.
In cases of slight negligence, PATH is liable where a material contractual obligation has been breached, limited to the foreseeable damage typical for the contract, insofar as legally permissible.
Mandatory statutory liability remains unaffected.
10. Intellectual Property
All designs, material developments, photographs, images, texts, graphics, and other content published on this website are protected by applicable intellectual property and copyright law.
Unless otherwise indicated, the relevant rights belong to Janine Grosche / PATH or are used with permission.
Reproduction, distribution, modification, publication, or commercial use without prior permission is prohibited except where permitted by law.
Purchase of a physical work does not transfer intellectual property or reproduction rights to the customer.
11. Data Protection
Personal data is processed in accordance with the Privacy Policy / Datenschutzerklärung available on this website.
12. Applicable Law
The law of the Federal Republic of Germany applies.
For consumers, this choice of law applies only insofar as it does not deprive the consumer of mandatory consumer-protection provisions applicable under the law of the country in which the consumer has their habitual residence.
Mandatory statutory provisions concerning jurisdiction remain unaffected.
13. Consumer Dispute Resolution
Janine Grosche / PATH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
